In the use of forsts as a natural resource and in the nature conservation there are interests carried through state administration. Man takes use of various benefits of the forest as products (goods) mediated through the market or as externalities. The main condition of the existence of the mankind is a sustainability of all these benefits, which is based on the existence of the forest as a renewable natural resource and depends on the stability of the forest as an ecosystem. This stability follows b.o. from the biological diversity. Both these elements are influenced through the forest managemanet planning and economic activity of the man. Nature conservation as forest's externaltiy has a character of public good and must be secured by tthe state - by the state administration of nature conservation (protection) or by the state administration of foestry, activities of which are supported by laws(acts). During the existence of socialistic state on the territory of the present day Czech Republic the previous state forestry administration and its competency and poss iblilities had been substantially reduced. The result of this was a menace to nature and devastation (e.g. Ore Mountains). Following conclusions of Minister's Conference for the protection of forests in Europe (Helsinki 1993) a new forest law is being prpared in Czech Republic, which together with the laws for protection of the nature willcreate a legal framework for functioning state forestry administration in the interests of nature prodection.
